The application form for permission to carry out activities relating photo or video shoots must be signed by the applicant. In case that it may be signed by any other person, notice that the undersigned will be considered liable for any damage caused.

For events of great magnitude a detailed report shall be issued together with a basic survey on ecological impact, if the place chosen affects an area of ecological sensitivity, under Art. 6 of the 11/1990 Act of 13 July 1990 on ecological impact prevention, having the possibility to be subject matter of a land assessment file (expediente de calificación territorial) when appropriate.

Applications must be delivered at the Registro General del Cabildo de Fuerteventura, located at C/ Virgen del Rosario, 39 (Puerto del Rosario) from 9:00 am to 2:00 pm.

FEES

There is no fee or tax established for service provision to carry out professional filming activities.

IN THE MUNICIPALITY OF PAJARA

DOCUMENTS TO BE ATTACHED TO THE APPLICATION FOR PERMISSION TO OCCUPY PUBLIC SPACES IN THE MUNICIPALITY OF PAJARA

FILMING

·         Application form addressed to the Mayor – President of the Town Council of Pájara, together with the legal representation credentials of the undersigned if acting on behalf of business companies or third parties.

·         Activity report containing at least the following information:

-          Type of shooting (advertisement, cinematography, documentary, etc.)

-          Spot and area where the shooting will be developed.

-          Date, time of shoot and duration.

-          Number of participants during development.

-          If any kind of installation is needed for the filming execution, complete description of such installation as well as security measures, fire prevention, access, lighting, ventilation, air conditioning, soundproofing, portable toilets, etc., if appropriate.

-                                                                                                                                                                                          Number and characteristics of vehicles used while filming. When appropriate, signed commitment to drive only by open rural tracks, not to open new ones and to restore the characteristics of the terrains that may be affected by the filming to its original state.

The application must be addressed to the Mayor – President of the Town Council of Pájara, together with the legal representation credentials of the undersigned if acting on behalf of business companies or third parties.

According to the Tax Regulations of the Town Council of Pájara:

When permission concerns the special use of local public places with any of the facilities referred in the Tax Ordinance by public tender, the tax amount will be determined by the economic value of the bid obtaining the concession, permission or granting.

If the special use is carried out without having the appropriate municipal authorization or permit, payment shall be done according to Art. 3 with respect to the periods previous to the granting thereof, after being verified by municipal technicians.

The State, the Autonomous Communities and the Local Entities are not bound to pay the taxes for exclusive or special use of public places, for the direct exploitation attached to public communication utilities or for any use directly concerning the public safety or the national defence.  

According to the provisions of Art. 9 of the Consolidated Text of Local Taxes Regulating Act (Texto Refundido de la Ley Reguladora de Haciendas Locales), a 5% bonus of the tax rate is established in favour of those taxpayers applying for the Special System of Tax Payment (Sistema Especial de Pago).

Opting for this special system will require the tax payment to be directly transferred to a bank entity or savings bank. The appropriate form established for these purposes must be submitted. The holder of the tax payment of the fiscal year in which the application is made must be the same for the following fiscal years.

IN THE MUNICIPALITY OF LA OLIVA

                PERMISSION TO CARRY OUT PHOTOGRAPHIC AND CINEMATOGRAPHIC ACTIVITIES IN LA OLIVA

The proceeding to obtain a permit to carry out photo and video shoots in the municipality of La Oliva is the following:

Submit an application stating the activity to develop, the spot where the shooting is going to take place, the number of persons taking part and whether any installations are to be set up in the area.

If the filming is developed in protected spaces, it is an essential requirement to obtain the permission of the Cabildo de Fuerteventura previously and if it is made in public foreshore spaces it is necessary to obtain the permission of the Coastline Demarcation Dept. of the Canary Islands (Demarcación de Costas de Canarias).

The Tax Ordinance regulating public prices for street and itinerant business and film shooting provides the payment of some taxes (€450.76 per day) for the execution of this activity.

IN THE MUNICIPALITY OF BETANCURIA

                                    MUNICIPALITY OF BETANCURIA

There are no ordinances regulating photo and video shooting within the municipal area. However, as the 90% of the municipal territory is covered by the Rural Park of Betancuria, any permission within its limits requires a previous report approved by the Park Managing Authority, which is under the Cabildo de Fuerteventura provisional competence until this organism is created.

 

HOW TO APPLY FOR PERMISSION

The application form for permission to carry out photo and video activities (see the form of the Environmental Department – Consejería de Medioambiente - of the Cabildo de Fuerteventura) must be signed by the applicant. In case that it may be signed by any other person, notice that the undersigned will be considered liable for any damage caused.
